GENERAL TERMS AND CONDITIONS

The following terms and conditions apply exclusively to the online sale of entry tickets to the MAIN TOWER observation platform (hereinafter: “Provider”) to the visitor (hereinafter: “Customer”). By making a purchase, the Customer accepts that the contractual arrangement is exclusively governed by these Terms and Conditions, as amended from time to time.

2. Conclusion of contract

The offers in the MAIN TOWER online shop are made without obligation and do not represent any legally binding offer but, rather, an invitation to purchase. By clicking the button “commit to order” in the final step of the order process, you declare a binding intention to purchase the contents of the shopping cart. Before sending the order, the Customer may change and view the data at any time. However, in order for the purchase order to be submitted and transmitted, by clicking on the buttons “I acknowledge that I have read and agree to the Terms and Conditions” and “I acknowledge that I have read and agree to the notices on data protection”. the Customer declares their acceptance of these conditions and that they are incorporated into the purchase order. The purchase agreement is concluded when we accept your order by transmitting the tickets (the form of transmission is determined by the Customer according to number 9).

3. Entry tickets

The observation platform of the MAIN TOWER may only be accessed with a valid online ticket. Children under the age of 6 may access the MAIN TOWER observation platform free of charge and must be accompanied by an adult guardian. You can obtain tickets for children and discounted tickets at the MAIN TOWER ticket counter.

4. Loss of ticket

In case an online ticket is lost, the Customer neither has a right to receive a replacement ticket nor to any other compensation. The same applies in cases of theft or misuse.

5. Entry and access entitlement

The online ticket entitles you to access the observation platform during the opening hours - these can be found at www.maintower.de. The ticket does not have a fixed timeslot and can be redeemed at any time. It loses its validity upon accessing the MAIN TOWER and validation at the ticket reader. Tickets are non-transferable once access has been gained. Online tickets that have been falsified or otherwise manipulated do not constitute an entitlement to access the observation platform and will be collected by the MAIN TOWER without replacement or compensation. The same applies in case of misuse of online tickets.

The MAIN TOWER reserves the right to partially or completely close parts of the observation platform or to restrict access to these areas. Such closures or access restrictions do not constitute grounds for claims by the visitor, in particular compensation claims.

6. Cancellation policy / right of revocation (section 13, German Civil Code)

You have the right to revoke the agreement within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party known to you have/has taken possession of the goods. To exercise your right of revocation, you must inform us,

of your decision to revoke the agreement by clear declaration (e.g. by e-mail, facsimile or a letter mailed by post). To comply with the revocation period, it shall be sufficient to send notification of exercising your right of revocation before the end of the revocation period.

7. Prices

All prices are final prices in euro and include statutory value added tax. Prices at the time of placing the order shall apply.

8. Payment

Payment on the website by credit card or direct debit as well as technical processing is handled by Beckerbillett GmbH, Fangdieckstrasse 61, 22547 Hamburg, Germany.

Payment of the purchase price must be made by 14 days after the order date at the latest. In case of delayed payment, the Customer must pay the MAIN TOWER interest on arrears of 5 % above the base interest rate. An obligation by the Customer to pay interest on arrears does not exclude an assertion of further damages incurred by the delay.

9. Delivery / dispatch

We will process your order immediately, at the latest however as soon as possible after we receive your order. Online tickets are provided to the Customer:
a) as print@home tickets. After successful completion of the payment process, the Customer receives the ticket in PDF format by e-mail and can print it out themselves.
b) as a QR code by e-mail.

Delivery of the tickets does not take place by post.

10. Data protection

It is pointed out that the data required in the course of the business process are processed and stored using EDP equipment according to section 33, German Data Protection Act and sections 13 ff., German Telemedia Act. Personal data is only collected, processed and used for the purpose of and time required for fulfilment of the contract. Thereafter it will be deleted.

11. Final provisions

The law of the Federal Republic of Germany excluding the provisions of the uniform UN Convention on Contracts for the International Sale of Goods (CISG) shall apply to contracts between the Provider and the Customer. If the Customer is a merchant, a legal entity under public law or a public special asset, jurisdiction for all disputes arising from contractual relationships between the Customer and the Provider is the location of the Provider. Even if any individual points of its terms are legally unenforceable, the contract shall remain binding in its remaining parts.
